Lake Eufaula is one of the largest man-made lakes in the United States. It covers a huge part of McIntosh County. Some lake properties have easements tied to the Army Corps of Engineers or other federal agencies. These restrictions can limit what the owner does with the land. The legal description on lakefront parcels sometimes references specific pool elevations or setback lines from the water.

Recording Fees in McIntosh County

McIntosh County uses the state fee schedule from Oklahoma Statutes Title 28, Section 32. A conforming deed costs $8.00 for the first page and $2.00 for each page after. The $10.00 records preservation fee applies to every instrument filed. That puts a one-page deed at $18.00.

Non-conforming documents cost $25.00 for the first page and $10.00 per added page. Plats are $10.00 for one block or less, $25.00 for more. Copies of McIntosh County deed records run about $1.00 per page. Certified copies add the certification fee.

Filing Deed Records in McIntosh County

Deeds recorded in McIntosh County must meet Oklahoma's format rules. The document needs to be an original or certified copy. Paper cannot exceed 8.5 by 14 inches. Top margin is 2 inches. The other three margins need 1 inch. It must be in English and readable. Full grantor names and signatures, grantee names and addresses, a legal description, and notary acknowledgment with seal are all required. These come from Title 16, Section 15 of Oklahoma law.

Since November 2023, an Alien Land Ownership Affidavit is required for each grantee under 60 O.S. Section 121. Forms are on the Oklahoma Attorney General's website. The McIntosh County Clerk will reject deeds without this affidavit unless an exemption applies.
