Muskogee County Recording Fees

Muskogee County uses the state fee schedule from Oklahoma Statutes Title 28, Section 32. A conforming deed is $8.00 for the first page and $2.00 for each extra page. The $10.00 records preservation fee is tacked on to every instrument. A one-page deed costs $18.00 total. Two pages run $20.00.

Non-conforming documents jump to $25.00 for the first page and $10.00 per additional page. Documents miss conforming status when they do not meet margin, size, or format rules. Plats cost $10.00 for one block or less, $25.00 for more. If a page lists more than 25 legal descriptions, it is $1.00 for each one past that number.

Copies of Muskogee County deed records run about $1.00 per page. Certified copies add the certification fee on top.

Filing Deed Records in Muskogee County

To record a deed in Muskogee County, the document must be an original or certified copy on paper no bigger than 8.5 by 14 inches. A 2-inch top margin is needed along with 1-inch margins on the sides and bottom. The deed has to be in English and clearly legible. All grantors must sign. Grantee names and mailing addresses must be listed. A specific legal description and notary acknowledgment with seal are required for the deed to be valid against third parties under Title 16, Section 15.

Since November 2023, every deed filed in Muskogee County requires an Alien Land Ownership Affidavit for each grantee under 60 O.S. Section 121. Forms are available from the Oklahoma Attorney General's website. Separate forms exist for individuals and for business entities or trusts. The Muskogee County Clerk will not record a deed without this affidavit unless a recognized exemption applies and is shown on the deed itself.

Note: Exemptions include correction deeds, transfer-on-death deeds, court orders, and conveyances to government bodies.

Muskogee County Deed Records and Oklahoma Law

Oklahoma runs a race-notice recording system. Under Title 16, Section 16-16, recording a deed at the Muskogee County Clerk creates constructive notice to all later buyers, lenders, and creditors. This matters for anyone involved in a property transaction in the county. Section 16-15 says a deed is valid between the parties even without recording, but if you skip filing it, a later buyer who records first and had no knowledge of your deed could take priority.
