The clerk acts as the ex officio Register of Deeds for Nowata County. That role means this single office handles every land record filing in the county. When a buyer closes on a property, sells a parcel, takes out a mortgage, or files a lien, the paperwork goes through this office. Once the clerk records a document, it becomes part of the public record. Anyone can walk in and ask to see a deed or get a copy. You do not need to be the property owner or have a legal reason to view these records. Oklahoma law treats deed records as open to the public.

Nowata County Recording Fees

Nowata County follows the state fee schedule set by Oklahoma Statutes Title 28, Section 32. A conforming deed costs $8.00 for the first page and $2.00 for each page after that. Every document also gets a $10.00 records preservation fee. So a one-page deed costs $18.00 total. Two pages run $20.00.

Non-conforming documents cost more. The first page jumps to $25.00. Each added page is $10.00. A document is non-conforming if it does not meet the margin, size, or format rules in the statute. Plats have their own fees. One block or less is $10.00. More than one block costs $25.00. If a page has more than 25 legal descriptions, you pay $1.00 for each one past that limit.

Copies of existing Nowata County deed records run about $1.00 per page. Certified copies cost $1.00 per page plus the certification fee.

Filing Deed Records in Nowata County

To file a deed in Nowata County, the document must meet specific format rules. It needs to be an original or certified copy. The paper cannot be larger than 8.5 by 14 inches. You need a 2-inch top margin and 1-inch margins on the sides and bottom. The deed must be in English and clearly legible. It needs the full names and signatures of all grantors, the names and mailing addresses of all grantees, and a specific legal description of the property. A notary acknowledgment with seal is required for the deed to be valid against third parties, per Title 16, Section 15 of Oklahoma law.

Since November 2023, every deed filed in Nowata County must include an Alien Land Ownership Affidavit for each grantee. This comes from 60 O.S. Section 121. You can get the forms from the Oklahoma Attorney General's website. There are separate forms for individuals and for business entities or trusts. The clerk will not accept a deed without this affidavit unless an exemption applies and is shown on the face of the deed.

Exemptions to the affidavit rule include deeds that correct a prior deed, transfer-on-death deeds, court orders, and deeds to government bodies.
