Kay County Recording Fees

Kay County follows the state fee schedule under Oklahoma Statutes Title 28. A conforming deed costs $8.00 for the first page and $2.00 for each page after that. Every document also carries a $10.00 records preservation fee. So a one-page deed runs $18.00 total. Non-conforming documents cost much more. The first page is $25.00 and each added page is $10.00. A document fails to conform if it does not meet margin, size, or format rules.

Kay County also collects documentary stamp tax on deeds that transfer property for value. The rate is $1.50 per thousand dollars of the sale price. To figure the exact amount, divide the sale price by $500, round up to the next whole number, and multiply by $0.75. Mortgage tax gets paid to the County Treasurer and the rate depends on the loan term. A mortgage of five years or more costs $0.10 per $100. Terms of four to five years cost $0.08 per $100. Shorter terms pay less. Every mortgage also has a $10.00 certification fee on top of the tax.

Copies of Kay County deed records are $1.00 per page. Certified copies cost $1.00 per page plus $1.00 for the certification stamp. Unofficial copies run $0.25 per page. The office also sells plat CDs. All Kay County plats on CD cost $179.75. Ponca City plats are $74.50 and Blackwell plats run $22.50.

Filing Deed Records in Kay County

To record a deed in Kay County, the document must be an original or certified copy. It has to be in English and easy to read without a magnifying glass. Paper size cannot go past 8.5 by 14 inches. You need a 2-inch top margin and 1-inch margins on the sides and bottom. The deed must have the full names and signatures of all grantors, the names and mailing addresses of all grantees, and a specific legal description of the property. Proper notary acknowledgment is required under Title 16, Section 15 of Oklahoma law for the deed to be valid against third parties.

Since November 2023, every deed filed in Kay County must include an Alien Land Ownership Affidavit for each grantee. This requirement comes from 60 O.S. Section 121. Get the forms from the Oklahoma Attorney General's website. There are separate forms for individuals and for business entities or trusts. The clerk will not accept a deed without this affidavit unless an exemption applies and is noted on the face of the document.

If a page has more than 25 legal descriptions, you pay $1.00 for each one past that limit. Documents with over 25 legals must be sorted by township, range, and section. The clerk can reject documents that are not properly sorted.
